Terms & conditions

1. Scope

The contracting party is Steffen Hofbauer, Goethestraße 17, 67547 Worms, Germany ("Contractor"). Clients may be businesses, self-employed professionals, or private individuals ordering services.

Any differing terms of the client apply only if the Contractor expressly agrees to them in writing.

2. Services and packages

The Contractor offers digital services in the following models:

• Einfach and Komplett as subscription-based website packages (including ongoing operation as defined in the offer).
• Nach Maß as a custom project for a website, a tool, or a combination of both.
• Tools, Apps & Automation as project-based services under an individual offer.

Scope, deadlines, and deliverables are defined exclusively in the accepted offer or contract.

3. Offers and contract conclusion

Requests made via website, email, or phone are non-binding. A contract is concluded when the client accepts a written offer (email is sufficient) or when the order is otherwise confirmed in writing.

4. Setup and one-time fees

The Einfach and Komplett packages include a one-time setup fee (concept, implementation, setup, and launch): regular 990 EUR (Einfach) and 1,790 EUR (Komplett), plus statutory VAT if applicable.

New customer promotion : A 50% setup discount applies to new customers for Einfach and Komplett as long as the promotion is shown on the website. A new customer is a client without an existing ongoing website contract with the Contractor.

Nach Maß and Tools, Apps & Automation are calculated per project; the regular setup prices of subscription website packages do not apply to these services.

5. Monthly pricing, annual payment, and term

The following prices apply to Einfach and Komplett (plus statutory VAT if applicable):

• Einfach : EUR 49 monthly or EUR 539 annually (prepaid).
• Komplett : EUR 79 monthly or EUR 869 annually (prepaid).

The minimum term is 12 months from contract start. After that, the contract continues for an indefinite period with monthly renewal. It does not automatically renew for another full year, even if annual prepayment was used before.

6. Cancellation

During the minimum term, ordinary cancellation is possible with 1 month notice to the end of the minimum term (text form, e.g. email, is sufficient).

After the minimum term, cancellation is possible with 1 month notice to the end of any month.

The right to terminate for good cause remains unaffected.

7. Client cooperation duties

The client must provide required content, access details, approvals, and feedback in due time. Delays caused by missing cooperation extend agreed deadlines accordingly.

The client is legally responsible for all supplied content (e.g. texts, images, trademark rights).

8. Fees and payment terms

Unless agreed otherwise, invoices are due within 14 days of the invoice date without deduction.

In case of payment delay, the Contractor may temporarily suspend services after prior notice.

9. Rights to deliverables and handover

Upon full payment, the client receives the contractually agreed rights of use to the deliverables. Any broader rights transfer requires explicit agreement.

After contract end, the Contractor can support website, domain, or data handover within reasonable limits upon request. Additional effort may be charged separately unless otherwise agreed.

10. Warranty

Services are provided according to the state of the art and the agreed specification. Defects must be reported promptly in text form.

If a defect is justified, remedial action will be provided within a reasonable period.

11. Liability

The Contractor is fully liable in cases of intent and gross negligence and for damages resulting from injury to life, body, or health.

In case of slight negligence of essential contractual obligations, liability is limited to foreseeable, typical damage. Otherwise, liability for slight negligence is excluded.

12. Data protection

Information on processing of personal data on this website is available in the Privacy Policy .

13. Changes to these Terms

The Contractor may amend these Terms for future contracts. For existing ongoing contracts, changes will be communicated in due time.

14. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction, where legally permissible, is Worms, Germany.
